Please read Section 11 (Disclaimers) and Section 12 (Limitation of Liability) carefully. They limit what we are responsible for.

2. Eligibility

3. The Site and your account

You may create an account to check out faster and view your order history. You are responsible for keeping your login credentials confidential and for all activity under your account. Tell us immediately at [SUPPORT EMAIL] if you believe your account has been compromised.

We may suspend or close any account, or refuse service to anyone, at any time, for any lawful reason, including suspected fraud or abuse.

4. Products and product information

We try to display our products, colors, and specifications as accurately as possible. Actual appearance may vary depending on your screen, lighting, and manufacturing variation.

Product descriptions, sizing, and availability may change without notice. We do not warrant that any description, image, or other content on the Site is complete, current, or error-free.

We may limit quantities per customer, per household, or per order, and we may discontinue any product at any time.

5. Pricing

All prices are shown in Canadian dollars (CAD) unless otherwise stated, and exclude taxes, duties, and shipping unless expressly included at checkout.

Prices, promotions, discount codes, and sale pricing may change at any time. A regular or compare-at price shown alongside a sale price reflects our own past or intended selling price for that product, not necessarily a price it has sold for in every market.

Pricing errors. If a product is listed at an incorrect price due to a typographical, technical, or system error, we reserve the right to cancel any order placed at that price, whether or not the order has been confirmed and payment taken. If we cancel, we will refund you in full.

6. Orders and acceptance

Your order is an offer to buy. Our order confirmation email acknowledges receipt of your order, it does not constitute acceptance. The contract is formed when we ship the product.

We may refuse, limit, or cancel any order, including where:

The product is out of stock or discontinued.
We suspect fraud, resale, or abuse of promotions or our refund policy.
Payment authorization fails or is reversed.
There is an error in the price or product description.
We cannot ship to your address.

If we cancel your order after payment, we will refund you in full.

7. Payment

We accept the payment methods shown at checkout. By providing a payment method, you represent that you are authorized to use it and you authorize us to charge the full order amount, including taxes and shipping.

Payments are processed by third-party providers. We do not store full payment card details. See our Privacy Policy for how payment information is handled.

You are responsible for any bank fees, foreign transaction fees, or currency conversion charges applied by your card issuer.

8. Shipping and delivery

We ship to the destinations listed at checkout. Free shipping applies to orders over $69 as shown on the Site. Shipping options, costs, and estimated delivery times are displayed before you complete your order.

Delivery estimates are estimates only, not guarantees. We are not responsible for delays caused by carriers, weather, customs, or events outside our control.

Risk and title pass to you when the product is delivered to the carrier for shipment, unless the law where you live says otherwise.

International orders. You are the importer of record. You are responsible for any customs duties, import taxes, brokerage fees, and compliance with local import laws. We do not refund these charges and we cannot mark shipments as gifts or undervalue them.

Address accuracy. You are responsible for entering the correct shipping address. Orders returned to us due to an incorrect address, refused delivery, or failure to collect may be subject to reshipping costs.

9. Refund and return policy

30-day money-back guarantee. If you are not happy with the Jawcradle, contact us at [SUPPORT EMAIL] within 30 days of delivery and we will refund your purchase price.

No physical return is required. For hygiene reasons, the Jawcradle is worn against the face and neck, so once it ships we cannot accept it back or resell it. There is nothing to mail back to us.

How it works:

Email [SUPPORT EMAIL] with your order number and the reason for the refund.
Refunds are issued to the original payment method within [5 to 10] business days of approval.
Original shipping charges, if any, are [refunded / not refunded — pick one].
The guarantee covers [one unit per customer / the full order — pick one]. We may decline repeat claims from the same customer, household, or payment method.

Damaged or wrong items. If your order arrives damaged, defective, or incorrect, email us within [7] days of delivery with photos and your order number and we will replace it or refund it at no cost to you.

Chargebacks. Please contact us before disputing a charge with your bank. We would rather just refund you. Filing a chargeback while a refund is already in progress may delay resolution.

This policy is in addition to, and does not limit, any rights you have under applicable consumer protection law.

10. Intended use and care

The Jawcradle is a wearable support band intended for cosmetic and general wellness use by adults.

Wear it snug, never tight. Do not over-tighten.
Stop using it and consult a healthcare professional if you experience pain, numbness, skin irritation, jaw or dental discomfort, headaches, or difficulty breathing.
Do not use it on broken, irritated, or infected skin.
Do not use it on children.
If you are pregnant, have a jaw or dental condition, a sleep-related breathing condition such as sleep apnea, a skin condition, or any other medical condition, talk to your doctor before use.
Follow the care and cleaning instructions included with the product.

You are responsible for using the product as intended and as instructed.

11. Disclaimers

Not a medical device. The Jawcradle is a cosmetic and wellness product. It is not a medical device and it is not intended to diagnose, treat, cure, or prevent any disease or medical condition. It has not been evaluated or approved by Health Canada, the U.S. Food and Drug Administration, or any equivalent regulator for any medical purpose.

Not medical advice. Nothing on the Site, in our emails, in our advertising, or in our customer support communications is medical, dental, or professional advice. It is general information about a consumer product. Always consult a qualified healthcare professional about your own situation. Never disregard or delay professional advice because of something you read on the Site.

Results vary. Individual results depend on age, skin condition, consistency of use, genetics, health, lifestyle, and other factors. Any timelines, outcomes, testimonials, reviews, or before-and-after images shown on the Site reflect individual experiences and are not a promise, prediction, or guarantee of the results you will get. We do not guarantee any specific outcome.

Site provided "as is." The Site and its content are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.

Consumer rights preserved. Some jurisdictions do not allow the exclusion of certain warranties. Nothing in these Terms excludes or limits any right you have under mandatory consumer protection law, including your statutory rights in Canada, the United States, the EEA, or the UK, or any liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

12. Limitation of liability

To the maximum extent permitted by law:

We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, or business interruption, arising out of or related to the Site or the products, whether based in contract, tort, negligence, strict liability, or otherwise, even if we have been advised of the possibility of those damages.
Our total aggregate liability to you for all claims arising out of or related to the Site or a product is limited to the greater of (a) the amount you paid us for the product giving rise to the claim, or (b) CAD $100.

These limits apply to the fullest extent permitted by law and do not apply where the law does not allow them.

13. Indemnification

All content on the Site, including the Jawcradle name, logo, product designs, photographs, videos, graphics, text, and copy, is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws.

You may view and use the Site for your own personal, non-commercial purposes. You may not copy, reproduce, scrape, republish, resell, or create derivative works from our content, or use our brand assets in advertising or as a competitor, without our prior written permission.

15. Reviews, photos, and other content you submit

If you submit a review, rating, photo, video, comment, or other content ("User Content") to us or through our review tools:

You grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, transferable, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display that content in any medium, including on the Site, in advertising, on social media, and in email marketing, without compensation to you.
You confirm you own or control the rights to the content, that it is truthful and reflects your honest experience, and that it does not infringe anyone's rights or violate any law.
If your content includes an image of a person, you confirm you have that person's permission.
We may edit, refuse to post, or remove any User Content at our discretion. We are not obligated to publish anything.
Do not submit content that is false, misleading, defamatory, obscene, harassing, or that makes medical claims about the product.

16. Prohibited uses

You agree not to:

Use the Site for any unlawful purpose or to violate any law or regulation.
Buy products for commercial resale without our written authorization.
Interfere with or disrupt the Site, its security, or its infrastructure.
Use bots, scrapers, crawlers, or automated tools to access the Site, harvest data, or make purchases.
Attempt to gain unauthorized access to any account, system, or network.
Submit false information, use a fraudulent payment method, or abuse promotions, discount codes, or our refund policy.
Impersonate any person or entity, or misrepresent your affiliation with anyone.
Upload malicious code, or transmit anything harmful, harassing, hateful, or discriminatory.

17. Third-party links and services

The Site may link to or integrate third-party websites, apps, and services. We do not control them and are not responsible for their content, products, or practices. Your dealings with third parties are between you and them.

18. Communications

By providing your email address, you consent to receive transactional messages about your orders and account. If you opt in to marketing emails or text messages, you may unsubscribe at any time using the link in any email or by replying STOP to any text. Message and data rates may apply to texts. See our Privacy Policy for details.

You agree that electronic communications and records satisfy any legal requirement that a communication be in writing.

19. Force majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, fire, flood, epidemic or pandemic, war, terrorism, civil unrest, labour disputes, carrier or supplier failure, government action, power or internet outage, or cyberattack.

20. Governing law and disputes

These Terms are governed by the laws of the [Province of Saskatchewan] and the applicable laws of [Canada], without regard to conflict of law principles. You and we submit to the exclusive jurisdiction of the courts located in [Saskatchewan, Canada].

If you are a consumer resident in another province, state, or country, this clause does not deprive you of the protection of the mandatory consumer laws of the place where you live, or of your right to bring a claim in your local courts where the law gives you that right.

21. General

Entire agreement. These Terms, together with our Privacy Policy and any other policies posted on the Site, are the entire agreement between you and us regarding the Site and your purchases.
Severability. If any provision is found unenforceable, the rest remains in full force, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
Headings. Section headings are for convenience only and have no legal effect.
